1. PROMOTION DATES
These rules (the “Official Rules”) govern the Q100.3 Miller Lite Undead Artist of the Day Giveaway (“Promotion”) which will begin on Tuesday, October 2, 2018 at 6 am ET and end on Wednesday, October 24, 2018 at 8 pm ET (the “Promotion Period”).
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to legal U.S. residents who are 21 years of age or older at the time of entry and who live in the State of Tennessee and within the Q100.3 terrestrial radio broadcast listening area (the “Promotion Area”). Employees of SummitMedia/Scripps Media Inc. d/b/a WCYQ (the “Station”), Cherokee Distributing (collectively, with Station the “Promoters”), Capitol Records/Nashville (Prize Provider”), and of their corporate parent, subsidiary, and affiliated entities, and of the advertising agencies, participating sponsors/promotional partners, and other entities involved in the development or administration of this Promotion, and of the other broadcasting stations in the Knoxville metropolitan area, and the members of those individuals’ immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. Void outside the Promotion Area and where prohibited.
b. Only one winner (and/or Qualifier (as defined below)) per household is permitted in any Station promotion. Individuals may win a Station promotion only once every 60 days, including all promotions conducted by WWST/Star 102.1, WKHT/Hot 104.5, WNOX/Classic Hits 93.1.
c. Entrants are required to provide truthful information, and Station will reject and delete any entry that it discovers to be false or fraudulent. Station will disqualify any entry from individuals who do not meet the eligibility requirements, and Station will also delete any online entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act and as otherwise required by law. All decisions of Promoters’ management with respect to the Promotion are final. By entering, you agree to these Official Rules and to the decisions of Promoters’ management.
To participate in the Promotion, you may enter via the following methods:
- VIA ON SITE – To enter on-site, entrants must visit participating retail locations (each, a “Location”). The Station van will be at each Location on the dates and times set forth below and there will be an on-site drawing in connection with each van visit, and a register to win box at these locations from 10/2-10/19:

Locations will have registration boxes on site to enter the Promotion. You may enter on the dates and times set forth above (for the first drawing at each Location) or any time thereafter through the end of the Promotion Period (for the second drawing at each Location). Accurately complete the official entry form (while supplies last) and deposit it in the box at the Location. All Location entries must be handwritten and must be on the official entry form. Failure to provide all required information may result in disqualification. Limit one entry per person, per Location. Entry boxes will be left on site at each Location through the end of the Promotion Period thru 10/19. Promoters will choose one qualifier for the Grand Prize drawing (“Qualifier”) from each Location’s box from all eligible entries received during the van visit. Promoters will also choose one Qualifier from each Location’s box after the close of the Promotion Period from all eligible, non-winning entries received during the entire time the box is at the Location. Odds of being chosen as a Qualifier at a Location depend on the number of eligible entries for each drawing at that Location. 1 qualifier will be drawn from each on-site location the day following the on-site event. 1 qualifier will also be drawn from each on-site registration box on 10/22 and notified of their finalist status. So, a total of 10 finalists will be drawn from on-location events.
b. VIA WEBSITE/ON AIR — To enter via the website/on-air method, entrants must acquire the name of the Undead Artist of the Day by listening to Q100.3 weekday mornings between 6 am and 7 am ET, as the on air talent will reveal the Undead Artist of the Day during that hour. Once entrants have the name of the Undead Artist of the Day, they must visit the Promotion page at www.Q100country.com and enter the Undead Artist’s name, along with their own name, complete address, city, state, zip code, telephone number (including area code) and date of birth. Every entrant who submits a valid online entry will be deemed a Qualifier for the Grand Prize drawing. Limit one on-line entry per person per day via the website/on-air method, for a total of 20 entries. Entrants may enter only in their own name. Entrants who attempt to enter under multiple emails with the same name/address will be disqualified, if discovered by Promoters. A total of 60 finalists will be drawn and notified from website entries. Up to 5 finalists will be drawn on site at the finale event on October 24th at Wild Wing Café, Powell, TN at 7pm.
4. GRAND PRIZE WINNER SELECTION AND NOTIFICATION
a. On October 24, 2018, Promoters will select one Grand Prize winner in a random drawing from among all of the Qualifiers. Odds of being selected as the Grand Prize winner depend on the number of eligible Qualifiers, Odds of being a Grand Prize winner are 1 in up to 75.
b. Station will attempt to notify the Grand Prize winner by telephone or email. Potential winner must respond within 24 hours of initial notification attempt. Winner must execute and return any required affidavit of eligibility and/or liability/publicity release prior to receipt of prize. (TN residents not required to complete publicity release.) If potential winner is not in compliance with these Official Rules (including eligibility requirements), does not respond within 48 hours of initial notification attempt, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release or provide required identification within the required time period, cannot travel on the dates specified below, or if a prize or prize notification is returned as undeliverable, potential winner will be disqualified and will forfeit the prize. Promoters will select an alternate prize winner by random drawing from remaining eligible Qualifiers. Promoters will conduct up to two alternate drawings, time permitting.
There is one Grand Prize. The Grand Prize is a three-day, two-night trip for two to Nashville for the 2018 Country Music Awards. b. Prize is awarded as-is. There is no substitution, transfer, or cash equivalent for prize, except that Promoters may, at their sole discretion, substitute prizes of comparable value or cash. The prize is expressly limited to the items listed above and does not include taxes, gratuities or any other expenses. Promoters are not responsible for winner’s limitations that prevent acceptance, use, or nonuse of prize. Entrants acknowledge that the Released Parties, as defined herein, have not made, nor are in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties expressed or implied, in fact or in law, whether now or hereafter enacted concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition, or fitness for a particular purpose, except for any express manufacturer’s warranty as may be included with the prize or as may be separately provided to participants by law. Other restrictions may apply. Properly claimed prize will be awarded, but in no event will Promoters award more prizes than are provided for in these Official Rules. Guest of winner must be 21 or older. Guest of winner may be required to sign and return release prior to accompanying winner on prize trip.
c. Any prize certificates or coupons are subject to the terms and conditions as set forth by the issuer of the certificate or coupon. Such certificates and coupons are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will such certificates or coupons be replaced if unused, lost, stolen, or damaged.
d. The Grand Prize must be claimed at the Station no later than 7 days after notification of winning, and winner will be required to sign and return all required documents and provide required identification prior to prize receipt.
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. Winner will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Promoters in their sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By entering, participating and/or accepting a prize in the Promotion, each entrant, winner, and guest if applicable, agrees not to sue and to release, discharge, indemnify, hold harmless, and absolve the Station, the Promoters, Prize Provider, and the sponsors and promotional partners, advertising and promotion agencies, and other entities involved with the development or administration of this Promotion, and each of their respective parent, subsidiary and affiliated entities and the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery. Promoters may require eligible Promotion winner and his or her travel companion, if any to sign a liability release confirming such consent. Except where prohibited, by entering the Promotion, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Prize(s) will be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Hamilton County, Ohio; (2) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event will such costs include attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded. Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you. This Promotion will be governed and enforced pursuant to Ohio law, excluding choice of law provisions.
c. Promoters, in their sole discretion, reserve the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of Station’s website or is otherwise in violation of the Official Rules or direction of Promoters. If a dispute arises regarding compliance with these Official Rules, Promoters may consider, in its sole discretion, data reasonably available to Promoters through information technology systems in Promoters’ control, but Promoters will not be obligated to consider any data or other information collected from any other source. Promoters further reserve the right, at their sole discretion, to modify, cancel, terminate or suspend the online portion of the Promotion if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoters’ control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoters in their sole discretion. If Promoters terminate the online portion of the Promotion, Promoters will announce its action on-air on the Station and online and will choose the winner by random drawing from among eligible, non-suspect online Qualifiers received as of the termination as well as all eligible, non-suspect Location Qualifiers. Promoters’ failure to enforce any term of these Official Rules will not constitute a waiver of this provision. If there is any conflict between any term of these Official Rules and any of the entry or marketing materials used in connection with the Promotion, the terms of the Official Rules will govern.
d. For those viewing/listening to the Station stream on the Internet or other non-broadcast means: Please be advised that you may be listening to a delayed stream of the broadcast signal, which may vary depending on your computer’s memory capacity and your dial-up connection. For that reason, we strongly recommend that you turn on your radio to the Station to participate in this or any other call-in promotion to be sure you are participating in “real time.” The Station assumes no responsibility for entrants not making timely phone calls to the Station as a result of the delays in the method of viewing/listening. The Station reserves the right to delay the announcement of the Undead Artist if breaking news or other unanticipated events prevent the playing from occurring as scheduled. If such changes occur, they will be posted on the Station’s website.
e. The Released Parties are not responsible for (1) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (2) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (3) lost, stolen, mangled, misdelivered, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of the Promotion prize that cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or of the name of the winner following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to Miller Lite Undead Artist of the Day Giveaway, Winner List or Official Rules Request, Q100.3, 1533 Amherst Road, Knoxville, TN 37909. Copies of the Official Rules and the name of the winner (when complete) are also available during regular business hours at Q100.3, 1533 Amherst Road, Knoxville, TN 37909. All such requests must be received within 60 days following completion of the Promotion.
