1. PROMOTION DATES
These rules (the “Official Rules”) govern the Q100.3 Money in the Music Sweepstakes (“Promotion”) which will begin on September 25, 2017 at or around 7:10 am ET and end on October 27, 2017 at or around 6:00 p.m. ET.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal U.S. residents who are 18 years of age or older at the time of entry and who live in Tennessee within the terrestrial over-the-air broadcast signal of WCYQ/Q100.3 (the “Promotion Area”). Employees of Scripps Media Inc., d/b/a WCYQ (the “Station”), A-1 Finchum Heating and Cooling, Dollywood, (collectively, the “Promoters”), Valory Music Company, Capitol Nashville Records, Mercury Nashville Records, Broken Bow Records (collectively, the record companies will be referred to as the “Prize Providers”), and of their corporate parent, subsidiary, and affiliated entities, and of the advertising agencies and participating sponsors/promotional partners associated with this Promotion, and of the other broadcasting stations in the Knoxville, TN metropolitan area, and the members of those employees’ immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. Void where prohibited and outside the Promotion Area. By participating, entrants agree to be bound by the Official Rules and the decisions or Promoters, which are final.
b. Individuals may win a Station contest or promotion only once every 60 days, including all contests or promotions conducted by Star 102.1/WWST, Hot 104.5/WKHT, and 93.1/WNOX. If an individual wins a prize valued at $600 or more, that individual will be ineligible to win a prize from this Station or the three above-mentioned stations for one year from date of winning
c. Entrants are required to provide truthful information, and Promoters will reject and delete any entry that they discover to be false or fraudulent.
3. ENTRY AND QUALIFIER SELECTION
To participate in the Promotion, listen to the Station weekdays during the Promotion Period. The Promotion will be played up to three times per weekday between 7:10 am ET and 6:00 pm ET (each a “Promotion Play”). At or around 7:10 am ET each weekday, the Station will announce the three times that day listeners need to listen to for the Promotion Plays and participate in the Promotion. Contestants will be asked to start counting the number of songs station plays during each Promotion Play. When a varying number of songs plays, Station will conclude the counting of songs by announcing the end of the Promotion Play and ask the 10thcaller at 865-656-7100 (the “Caller”) to tell Station how many songs just played in a row (i.e., continuous, commercial-free songs) in the Promotion Play. The Station will also announce the Promotion Play in advance. If the Caller knows the correct number of songs, the Caller will win a minimum prize of $25 per song played for that Promotion Play, and, during the first four weeks of the Promotion Period, that Caller will also be named a qualifier (“Qualifier”) for a Grand Prize drawing (there will be no Grand Prize drawing for the fifth week of the Promotion Period). At select times during the Promotion, the value of the prize per song will vary, but it will never be less than $25 per song. The prize amount will be announced in advance of the Promotion Play. If the Caller incorrectly answers the number of songs played in the Promotion Play, the Caller will not win, and that individual will not be eligible to participate in the Promotion for 48 hours after the incorrect guess. At the time of their call, the Caller must provide all requested information, including, their first name and last name, complete address, city, state, zip code, email address, telephone number, and date of birth. Use of any device to automate entry is prohibited. The Station’s telephone system is the official time keeping device for the Promotion.Qualifiers will be notified at the time of their phone call. Once you have won a prize, you may not participate again as a Caller.
4. QUALIFIER NOTIFICATION AND VERIFICATION
Qualifiers may be required to execute and return any required affidavit of eligibility and/or liability/publicity release (TN residents are not required to sign publicity release) within 48 hours of notification of their status as a Qualifier and prior to receipt of Qualifier prize. If a potential Qualifier is not eligible or is not in compliance with these Official Rules or fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, potential Qualifier will be disqualified and will forfeit the Qualifier prize.
5. GRAND PRIZE WINNER SELECTION, NOTIFICATION, AND VERIFICATION
On or about September 29 (week one), October 6 (week two), October 13 (week three), and October 20 (week four), Station will select one Grand Prize winner by random drawing from eligible Qualifiers selected that week. Please note, there will be no Grand Prize for the fifth week of the Promotion Period, and Qualifiers selected for that week will receive only the Qualifier prize. Odds of winning a Grand Prize will be up to one in 15. Qualifiers will not carry over from one weekly Grand Prize drawing to the next. Station will attempt to notify potential Grand Prize winners by telephone or email, and potential winner must respond within 48 hours of initial notification attempt. Grand Prize winners may be required to execute and return any required affidavit of eligibility and/or liability/publicity release (TN residents are not required to sign publicity release) within 48 hours of notification of their status as a prize winner and prior to receipt of prize. If a potential winner is not eligible, is not able to travel on the dates designated below, fails to respond with 48 hours of initial notification attempt, is not in compliance with these Official Rules, or fails to complete, sign and return the required affidavit of eligibility and liability/publicity release or provide required identification within the required time period, potential Grand Prize winner will be disqualified and Station may select an alternate winner by random drawing from among remaining Qualifiers for that drawing, time permitting.
a. Up to 15 Qualifiers will be chosen per week, and up 75 Qualifiers will be chosen during the Promotion Period. Prizes will vary in value from $25 up to $500. Each Qualifier will also win two tickets to Dollywood with an approximate retail value (“ARV”) of $130. The total value of all Qualifier prizes will depend on the number of winners and the size of the prizes the Qualifiers receive, which will in turn depend on the number of songs played in a Promotion Play and the amount awarded per song in a Promotion Play. Each Qualifier money prize will be awarded in the form of a check.
b. There will be four Grand Prizes, one for each of the first four weeks of the Promotion Period. Each Grand Prize is a trip for two to a concert (each, a “Show”). The Grand Prizes are as follows:
Week 1 (9/25 - 9/29)
This Grand Prize is a three-day, two-night trip for two to Pensacola, Florida, to see Thomas Rhett with Dan + Shay & Walker Hayes in concert on Friday, October 13, 2017. Prize consists of two tickets to the Home Team World Tour show at the Pensacola Bay Center in Pensacola, FL; roundtrip, coach-class airfare for two from Knoxville, and two nights hotel accommodations (standard, double room). Week 2 (10/2 - 10/6)
This Grand Prize is a three-day, two-night trip for two to North Myrtle Beach, South Carolina, to see Jon Pardi with Midland & Runaway June in concert on Saturday, November 4, 2017. Prize consists of two tickets to the Lucky Tonight Tour show at the House of Blues in North Myrtle Beach, SC; roundtrip, coach-class airfare for two from Knoxville, and two nights hotel accommodations (standard, double room). Week 3 (10/9 - 10/13)
This Grand Prize is a three-day, two-night trip for two to Columbus, Ohio, to see Chris Stapleton with Marty Stuart in concert on Friday, November 3, 2017. Prize consists of two tickets to the All American Road Show at Nationwide Arena in Columbus, OH; roundtrip, coach-class airfare for two from Knoxville, and two nights hotel accommodations (standard, double room). Week 4 (10/16 - 10/20)
This Grand Prize is a three-day, two-night trip for two to New York City, to see Dustin Lynch with Ryan Hurd in concert on Saturday, December 2, 2017. Prize consists of two tickets to the Ride or Die Tour, show at the PlayStation Theater in New York City and meet and greet with Dustin Lynch; roundtrip, coach-class airfare for two from Knoxville, and two nights hotel accommodations (standard, double room). ARV: $2,000. The trip is courtesy of Broken Bow Records.
c. The ARV of each Grand Prize listed above may vary based on air travel fluctuations and other variables. If actual value is less than stated ARV, difference in prize value will not be awarded. Show tickets and hotel accommodation must be used at same time, and must be used on the dates set forth above. Winner may be required to provide a major credit card at hotel check-in for incidental expenses. Use of Show tickets is subject to all rules and restrictions of Show promoters and the venue. Seat location will be in the sole discretion of Sponsor and prize provider. Sponsor and prize provider will not be responsible for weather, talent illness or other inability to perform, acts of God, acts of terrorism, civil disturbances, strike, work stoppage, or any other natural disaster outside their control that may cause the cancellation or postponement of the Show, and the terms and conditions of the tickets will govern in such event. Sponsor will not replace lost, stolen or damaged prize tickets or similar items once they have been given to winner. If winner is unable to attend Show by designated deadline, prize will be forfeited. Guest of winner (and parent or legal guardian of guest who is a minor) may be required to sign and return release prior to attending Show with winner. Guest of winner who is a minor must be accompanied at all times by parent or legal guardian.
- All prizes are awarded as-is. There is no substitution, transfer, or cash equivalent for prizes, except that Promoters may, at their sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Promoter are not responsible for winners’ limitations that prevent acceptance, use, or nonuse of prize. Entrants acknowledge that the Released Parties, as defined herein, have not made, nor are in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties expressed or implied, in fact or in law, whether now or hereafter enacted concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition, or fitness for a particular purpose, except for any express manufacturer’s warranty as may be included with the prize or as may be separately provided to participants by law.
b. Unless otherwise specified in the prize notification, all prizes must be picked up at the office of the Promoter at the address below during regular business hours. The winner will forfeit any prize not claimed within 72 hours of winning (or sooner if notified by Station at the time of notification).
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Prior to awarding any prize, and depending on the nature of the prize and eligibility requirements of the Promotion, the Promoters in their sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By entering, participating and/or accepting a prize in the Promotion, each entrant and winner agrees not to sue and to release, discharge, indemnify, hold harmless, and absolve the Promoters, the Prize Providers, and the advertising and promotion agencies and any other entities involved with the development or administration of this Promotion, and each of their respective parent, subsidiary and affiliated entities and all of the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery. Except where prohibited, by entering the Promotion, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes must be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Hamilton County, Ohio; (2) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event will such costs include attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded. This Promotion will be governed and enforced pursuant to Ohio law, excluding choice of law provisions.
c. Promoters, in their sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or is otherwise in violation of the Official Rules or direction of Promoters. If a dispute arises regarding compliance with these Official Rules, Promoters may consider, in their sole discretion, data reasonably available to Promoters through information technology systems in Promoters’ control, but Promoters will not be obligated to consider any data or other information collected from any other source. Promoters further reserve the right, at their sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoters’ control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoters in their sole discretion. If Promoters terminates the Promotion, Promoter will announce its action on air on the Station and on the Promotion website and will not hold additional Promotion Plays and will award the Grand Prize for the week in progress at the time of termination by random drawing from among eligible, non-suspect Qualifiers received for that week as of the termination. Promoters’ failure to enforce any term of these Official Rules will not constitute a waiver of this provision. If there is any conflict between the terms of these Official Rules and any marketing or entry materials used in connection with the Promotion, the terms of the Official Rules will govern.
d. For those viewing/listening to the Station stream on the Internet or other non-broadcast means: Please be advised that you may be listening to a delayed stream of the broadcast signal, which may vary depending on your computer’s memory capacity and connection. For that reason, we strongly recommend that you turn on your radio to the Station to participate in this Promotion to be sure you are participating in “real time.” The Station assumes no responsibility for entrants not making timely phone calls to the Station as a result of the delays in the method of listening.
e. The Released Parties are not responsible for (1) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (2) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (3) lost, stolen, mangled, misdelivered, misdirected, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a prize that cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winners List” to The Money in the Music Sweepstakes, 1533 Amherst Road, Knoxville, TN 37909. Copies of the Official Rules and a list of winners (when complete) are also available during regular business hours at WCYQ/Q100.3, 1533 Amherst Road, Knoxville, TN, 37909. All such requests must be received within 60 days following completion of the Promotion.
